SMS Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the Cheer and Pom SMS notification service (the "Service"). By providing your mobile phone number and consenting to receive SMS messages, you agree to these Terms.

1. Description of Service

The Cheer and Pom SMS notification service is operated by C2 Content & Consulting LLC, which owns and operates this website, the enrollment form, and the sending phone number. Messages are sent under the Cheer and Pom name. The Service delivers athlete absence notifications to designated recipients (head coaches, assistant coaches, and designated team parents) for each of the program's seven (7) competitive teams. When a parent submits an absence report through the Cheer and Pom absentee form, the Service automatically sends an SMS alert to the head coach and team parent assigned to that athlete's team, as well as to the Cheer and Pom Director for organizational oversight.

2. Eligibility and Consent

The service is offered to adult volunteers aged 18 or older who serve as head coaches, assistant coaches, designated team parents (sometimes called team moms), or the Cheer and Pom Director, and who personally opt in using their own mobile number. During the annual volunteer onboarding process, each volunteer enrolls themselves by completing the Cheer and Pom Volunteer SMS Enrollment Form, entering their own mobile number and selecting the consent checkbox. No one is enrolled on another person's behalf.

At the time of enrollment, each recipient is presented with the following consent disclosure via a digital enrollment form:

Selecting the consent checkbox and submitting the enrollment form constitutes express written consent to receive SMS messages through this Service. Providing consent is optional; it is not required to submit the form and is not a condition of volunteering, employment, or continued participation with Cheer and Pom. A volunteer may complete onboarding without enrolling in SMS.

3. Opt-Out Instructions

You may opt out of SMS messages at any time by replying with any of the following keywords to any message received through the Service:

STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT

After sending an opt-out keyword, you will receive a single confirmation message acknowledging your request, after which no further SMS messages will be sent to your number. You may opt back in at any time by replying START.

4. Help

For assistance, reply HELP or INFO to any message received through the Service. You will receive a response with contact information and a brief description of the Service. You may also contact Cheer and Pom directly using the contact information at the end of these Terms.

5. Message Frequency

Message frequency varies and depends on the number of absences submitted for your team during the active competitive season (approximately May through December). You may receive multiple messages per week during peak periods (competitions, pre-event practices) and few to no messages during the off-season.

6. Message and Data Rates

Message and data rates may apply based on your mobile carrier plan. Cheer and Pom does not charge to send or receive SMS messages through this Service; however, standard messaging rates from your carrier may apply to each message sent or received. Please consult your mobile carrier for details regarding your plan's messaging and data rates.

7. Supported Carriers

The Service is supported on major U.S. mobile carriers, including AT&T, Verizon Wireless, T-Mobile, U.S. Cellular, and most regional and MVNO carriers. Carriers are not liable for delayed or undelivered messages. Delivery is subject to the availability and coverage of your wireless carrier.

8. Privacy

Your use of the Service is also governed by the Cheer and Pom SMS Notification Service Privacy Policy, which describes how we collect, use, and protect information in connection with the Service. By using the Service, you acknowledge that you have read and agree to the Privacy Policy.

Cheer and Pom does not sell, rent, share, or disclose your mobile phone number or any personal information to third parties for marketing or promotional purposes under any circumstances.

9. Changes to the Service

Cheer and Pom reserves the right to modify, suspend, or discontinue the Service, in whole or in part, at any time without prior notice. We also reserve the right to modify these Terms at any time. Material changes will be communicated to active recipients via SMS or email, and the "Effective Date" at the top of these Terms will be updated to reflect the date of the most recent revision.

10. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. Cheer and Pom makes no warranties, express or implied, regarding the timeliness, accuracy, or reliability of SMS message delivery. To the maximum extent permitted by law, Cheer and Pom, its volunteers, directors, officers, and affiliated service providers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service, including, without limitation, failed, delayed, or misdirected messages or any reliance placed on information contained in messages.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Sumter County, Florida.
